If you do not serve a notice of appearance or demand for a complaint within the applicable time limitation stated above, a judgment pursuant to RPAPL Section 1521 and/or N.Y. C.P.L.R. Amending Chapter 55 of the Code of Putnam County entitled “Ethics, Code of, and Financial Disclosure” adopted by the Putnam County Legislature on October 6, 2015 by Resolution R#212.

This Local Law amends Section 55-2 by clarifying that a “County Officer or Employee shall not include a member of an advisory board of the County if, but only if, the advisory board has no authority to implement its recommendation or to act on behalf of the County or to restrict the authority of the County to act, and such member is not entitled to participate in making recommendations regarding policy.

Amending Section 55-7 of the Code of Putnam County Entitled “Annual Disclosure Statements” adopted by the Putnam County Legislature on October 6, 2015 by Resolution R#213.

This Local Law amends Section 55-7 of the Putnam County Code by adding a provision which would allow any person required to file an annual financial disclosure statement to request, in writing, an exemption from any requirement to report one or more items of information which may pertain to such person’s spouse or unemployed child, which item or items may be exempted by the Board of Ethics upon a finding by the Board that such individuals object to providing the information necessary to make disclosure and that the information would have no material bearing on the discharge of the reporting person’s official duties.

LEGAL NOTICE NOTICE OF SPECIAL SCHOOL DISTRICT MEETING ADDITIONAL PERSONAL REGISTRATION AND ABSENTEE BALLOTS

Putnam Valley Central School District Putnam and Westchester Counties, New York

PLEASE TAKE NOTICE that a Special School District Meeting of the qualified voters of the Putnam Valley Central School District, Putnam and Westchester Counties, New York, will be held on December 8, 2015 (the “Special District Meeting”) at 3:00 P.M. at Putnam Valley High School at 146 Peekskill Hollow Road in Putnam Valley, New York, in said School District, at which the polls will be kept open between the hours of 3:00 o’clock P.M. and 9:00 o’clock P.M., Prevailing Time, for the purpose of voting by voting machine upon the following proposition:

CAPITAL RESERVE FUND PROPOSITION

Shall the following resolution be adopted, to wit:

RESOLVED, that the Putnam Valley Central School District, Putnam and Westchester Counties, New York, is hereby authorized to establish a capital reserve fund pursuant to Section 3651 of the Education Law to be designated “Buildings and Facilities Improvement Reserve Fund” in order to pay the cost of the construction of additions to, improvements to, reconstruction and equipping of School District buildings, facilities and athletic fields and tracks, including original furnishings, equipment, machinery, apparatus, appurtenances, and site and incidental improvements and expenses in connection therewith, at an ultimate amount of $10,000,000, plus accrued interest and investment earnings, with a probable term of ten (10) years, the source of funding to be surplus dollars when it closes its books every June 30 and/or legally available funds available to the District.

If necessary, due to space constraints on the voting machines, said proposition may be presented in substantially the following abbreviated form:

CAPITAL RESERVE FUND PROPOSITION

Shall the Proposition set forth in the notice of this meeting authorizing establishment of a capital reserve fund for construction of additions, improvement, reconstruction and equipping of District buildings and facilities, including incidental improvements and expenses, at an ultimate amount of $10,000,000 and term of 10 years with annual appropriation from surplus fund balances and other available funds to such reserve fund?

If so presented in abbreviated form, the full text of the proposition shall be posted at the voting location and will be available in the office of the School District Clerk where it may be inspected during regular office hours.

The School District has acted as lead agency under the State Environmental Quality Review Act regulations of the State of New York. The establishment of the Capital Reserve Fund is a “Type II Action” pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act (“SERA”), the implementation of which as proposed, such regulations provide will not result in a significant environmental effect.

ABSENTEE BALLOTS: NOTICE IS ALSO HEREBY GIVEN that applications for absentee ballots for the Special District Meeting, in accordance with Section 2018-b of the Education Law may be obtained at the office of the School District Clerk. Any such application must be received by the District Clerk at least seven days before the date of the aforesaid Special District Meeting if the ballot is to be mailed to the voter, or the day before such Special District Meeting, if the ballot is to be delivered personally to the voter. A list of all persons to whom absentee voters ballots shall have been issued shall be available for public inspection in the office of the School District Clerk not less than five days prior to the date of the Special District Meeting (excluding Saturdays and Sundays) during regular office hours between the hours of 8:00 A.M. and 4:00 P.M. until the date of the aforesaid Special District Meeting. Absentee ballots must be received by 5:00 P.M. on date of the Special District Meeting in the office of the School District Clerk. A list of all persons to whom absentee ballots have been issued shall be maintained in the Office of the District Clerk and made available for public inspection during regular office hours until the day of the Special Election. Any qualified voter may, upon examination of such list, file a written challenge of the qualifications as a voter of any person whose name appears on such list, stating the reason for such challenge. The written challenge shall be transmitted by the District Clerk to the election inspectors on the day of the Special Election. In addition, any qualified voter may challenge the acceptance of the absentee voter’s ballot of any person on such list by making his/ her reasons known to the election inspector before the close of the polls.

QUALIFIED VOTERS: FURTHER NOTICE IS HEREBY GIVEN that the qualified voters of the School District shall be entitled to vote at said Special District Meeting. A qualified voter is one who is (1) a citizen of the United States, (2) eighteen (18) years of age or older, and (3) resident within the School District for a period of thirty (30) days next preceding the Special District Meeting and not otherwise prohibited from voting (i.e. mentally incompetent or convicted felon).

Qualified voters must be registered voters in order to vote at said Special District Meeting.

ADDITIONAL PERSONAL REGISTRATION:

NOTICE IS HEREBY ALSO GIVEN that pursuant to Section 2014 of the Education Law, personal registration of voters is required for said Special District Meeting and no person shall be entitled to vote thereafter whose name does not appear upon the register of the School District or on the permanent personal registration lists of the Counties of Putnam or Westchester. Persons otherwise qualified to vote, who have been previously registered for School District voting and voted during these last four (4) calendar years, need not personally register for this special election. Persons who have registered to vote in town, county, or national elections pursuant to Section 352 of the Election Law need not personally register for this special election. Any person eighteen years of age or over, and a citizen of the United States, and a resident of the District for thirty (30) days next preceding the day for voting (and not otherwise prohibited from voting) is entitled to register and vote. Voters may register with the Board of Registration at the High School, 146 Peekskill Hollow Road, Putnam Valley, NY, on November 19, 2015 between the hours of 4:00 P.M. to 8:00 P.M. and on December 2, 2015 at the Elementary School, 171 Oscawana Lake Road, Putnam Valley, New York, between the hours of 3:00 P.M. to 7:00 P.M. to add additional names to the Register to be used at the aforesaid Special District Meeting; at which time any person will be entitled to have his or her name placed on such Register, provided, that at such meeting of the Board of Registration he or she is known or proven to the satisfaction of said Board of Registration to be then or thereafter entitled to vote at such Special District Meeting for which the Register is prepared. Such registration shall not take place less than two days preceding the date of the Special District Meeting.

The Register of the School District so prepared and the permanent personal registration lists for the Counties of Putnam and Westchester will be filed in the office of the School District Clerk, located at 146 Peekskill Hollow Road, Putnam Valley, New York, where the same will be open for inspection by any qualified voter of the District, between the hours of 8:00 A.M. to 4:00 P.M. prevailing time, beginning five days prior to such election on weekdays and each day prior to the day set for the election except Sunday, and at the polling place on the date of the vote.

NOTICE OF TAX DELINQUENCY STATE OF NEW YORK PUTNAM COUNTY COMMISSIONER OF FINANCE

CARMEL, NEW YORK

WHEREAS, arrears of taxes for the levy of 2015, charged and imposed pursuant to law, remain due and unpaid on various lots, tract, pieces or parcels of land located within Putnam County and as described in the attached list by Tax Map Number; and

WHEREAS, the Tax Map Number is in accordance with the official tax maps of the Putnam County Real Property Tax Department, and is the official description; and

WHEREAS, the name given being those of the owners or occupants as the same appear on the assessment rolls for the levy 2015 and the aggregate amount due on each parcel as of the time of filing the Notice of Tax Delinquency, such amounts including unpaid taxes, interest, expenses and other charges against the properties for such year.

NOW, therefore, notice is hereby given that pursuant to the power vested in me, on the 2nd day of November, 2015, I will file with the Putnam County Clerk a list of delinquent taxes on all parcels, or respective lots, tracts, pieces or parcels of land setting forth the tax amount due which shall be sufficient to pay the State, County, Town, Highway, School, or other taxes assessed thereon in the levy year 2015 on each thereof, respectively, together with interest, expenses, and charges which have arisen or accrued or that may arise on November 2, 2015.

BE FURTHER advised that the filing of such list shall constitute constructive notice, to a purchaser from or encumbrance against, any owners or occupants of all tax map numbers listed herein with the same force and effect as the filing of an individual and separate notice of Pendency pursuant to Article Sixty-Five (65) of the Civil Practice Laws Rules.

FURTHER NOTICE GIVEN THAT WHEN TWO (2) YEARS HAVE EXPIRED (JANUARY 1, 2017), AFTER THE DATE ON WHICH THE TAX BECAME A LIEN (JANUARY 1, 2015), THE LIEN WILL BE SUMMARILY FORECLOSED BY THE COUNTY OF PUTNAM IN THE MANNER PROVIDED BY TITLE 3 OF ARTICLE 11 OF THE REAL PROPERTY TAX LAW ON FORECLOSURE OF SAID LIEN. THE OWNERS OR OCCUPANTS COULD THEN LOSE ALL RIGHT, TITLE AND INTEREST IN THE PROPERTIES LISTED ON THE ATTACHED LISTS.
